Summary

This summary is for convenience. The full Terms below are what apply.

  • Minty is an online marketplace for non-medical household services in the Rochester and Monroe County, New York area. We help Households and independent Professionals find each other.
  • Minty is not the Professional’s employer, an employment agency, a home-care agency, a transportation company or a food business. We do not provide the services.
  • A Household and a Professional make their own agreement with each other. Minty is not part of it.
  • Households pay through the Platform using Stripe. Professionals set their own rates. Households also pay Minty a service fee, currently 15% under the Household Agreement.
  • Professionals complete a background screening through Checkr before they are listed. A badge or “verified” label describes one specific check. It is not a promise of safety, quality, licensing or insurance.
  • Minty is for non-medical help only. No nursing, medical care, medication help or emergency services.
  • Use your own good judgment. Check references, credentials and insurance before you hire or accept work.
  • If you accepted a Household Agreement or Professional Agreement, it also applies to you and controls if it conflicts with these Terms.

1. About these Terms

1.1 What these Terms cover. These Terms of Use (“Terms”) apply when you use www.mintycareconnections.com and any related websites, pages and features run by Minty Care Connections LLC (“Minty,” “we,” “us” or “our”), together called the “Platform.” They explain how the Platform works and what we expect from everyone who uses it. They do not make Minty a party to any agreement for household services.

1.2 How you accept. You accept these Terms by clicking to agree when you register, or at any other point where we ask. If you do not agree, please do not register, book, list services or use account features.

1.3 Other documents that may apply to you. Depending on how you use the Platform, you may also be bound by:

  • the Household Agreement, which Households accept when they register;
  • the Professional Agreement, which Professionals accept when they register; and
  • our Privacy Policy and Cookie Policy.

1.4 If documents conflict. These Terms work alongside the Household Agreement and the Professional Agreement. If a provision of these Terms conflicts with the agreement you accepted, that agreement controls, unless mandatory law says otherwise. These Terms do not amend, replace or waive any part of those agreements. Those agreements can be changed only through the amendment process they set out.

1.5 These Terms are not a service contract. A Household and a Professional make their own agreement for services (see Section 6). These Terms do not serve as that agreement.

2. Key words

  • Household: an adult individual or an entity seeking permitted non-medical services through Minty for itself or on behalf of another person, family, group or organization. It includes parents, family members, caregivers, authorized representatives, businesses and other organizations. An individual acting for another person or entity must have authority to register, share information and enter into the applicable agreements on its behalf. Household is an account-role label and is not limited to a private residence or traditional family household.
  • Professional: an adult individual or business that offers permitted non-medical services through Minty. A person acting for a business must have authority to register and accept agreements for it. The term describes a platform role and does not itself establish licensing, qualifications, employment status or an endorsement by Minty.
  • Assistant: an employee, subcontractor or helper that a Professional engages to help perform services.
  • Member: anyone with a Minty account, whether a Household or a Professional.
  • Service Agreement: the separate agreement between a Household and a Professional for particular services.
  • Services: the non-medical household services described in Section 5.
  • Screening: identity verification and background checks carried out through Checkr or another provider we designate.
  • Stripe: the third-party payment processor we currently use, and any replacement we designate.
  • Listing: a Professional’s profile and service description on the Platform.

3. What Minty is, and what it is not

3.1 Minty is a platform operator. We provide technology and information that let Members find Listings, communicate, make bookings and use payment tools.

3.2 What Minty does not do.

We do not:

  • provide household services;
  • employ or engage Professionals to perform services for Households;
  • act as an employment agency, staffing agency, home-care agency, transportation carrier or food-service business;
  • choose a Professional for a Household;
  • supervise or direct how work is done, or supply tools or supplies; or
  • set a Professional’s rates, schedule, availability, routes or choice of customers.

Platform eligibility rules, account security, lawful-use rules and payment administration do not give Minty the right to direct how services are performed.

3.3 Professionals are independent. Each Professional runs its own business. Professionals set their own rates, service areas, schedules and equipment, pay their own business expenses, and may accept or turn down any engagement, subject to commitments they have made and to the law. Professionals may keep their own customers and use other platforms. They may choose whom to work with on lawful grounds. This freedom does not permit unlawful discrimination or retaliation.

3.4 Labels and badges. A Listing, badge, title or onboarding step does not by itself create an employment or agency relationship with Minty. Legal status depends on the law and the real relationship, not on labels. Nothing in these Terms waives a legally established employment relationship or the duties that come with it.

3.5 No authority to bind Minty. No Member may make promises on Minty’s behalf, bind Minty, or say that a Professional works for Minty.

4. Who can use the Platform

4.1 Age and capacity. You must be at least 18 and legally able to enter into contracts.

4.2 Acting for someone else. If you use the Platform for a family member or an organization, you must have the authority to book, share information, allow access and commit funds for them. You may not give up another person’s legal rights unless the law allows it. Referring someone to the Platform, or using it for a client, does not make Minty your partner or agent and does not create a clinical or service-delivery duty for Minty.

4.3 Accurate information. Give accurate contact details and use your legal name or legal entity name, as applicable. Keep the profile photo current and make sure it accurately identifies the individual or authorized representative on the account. Update important changes promptly. Do not use false documents, pretend to be someone else, or let an undisclosed person work under your name or account.

4.4 Account security. Keep your login details private and tell us promptly if you think someone used your account without permission. Reporting a compromised account does not automatically make you responsible for every unauthorized charge. Responsibility is decided under applicable law.

4.5 Keep sensitive details out of messages. Do not send Social Security numbers, payment card details, identity documents, passwords or sensitive medical records in ordinary messages. Use the secure process we or our providers set up when sensitive information is needed.

5. What services are allowed

5.1 Non-medical household services. Minty is for non-medical household support: home cleaning, laundry, yard care, meal preparation, errands, friendly visits and non-medical companionship, and non-emergency transportation for independently mobile adults.

5.2 What may not be offered or requested. Do not list or request medical, diagnostic, treatment or nursing services, medication administration, hands-on personal care, emergency services, or any work that needs a license, permit or registration the Professional does not hold. Pesticide and herbicide application is prohibited under the yard-care platform rule in Section 15.3, even where a Professional holds relevant certification or licensing. Do not assume that a general Listing allows hazardous-material removal or licensed trade work.

5.3 Availability. Features and service categories may vary by location and by launch stage, and some may not be available yet. We currently focus on the Rochester and Monroe County, New York area.

5.4 Emergencies. Minty does not monitor for emergencies and cannot send help. In an emergency, call 911.

6. How a booking works

6.1 Choosing and agreeing. Households choose their own Professionals, and Professionals decide which engagements to accept. A Service Agreement exists only when both sides agree to its terms. A Listing, inquiry, proposed booking or payment authorization is not by itself a promise that a Professional has accepted the work.

6.2 What to agree on. Households and Professionals should agree on, and keep a record of:

  • what work will be done and what is not included;
  • the price and how it is calculated;
  • who pays for supplies and other expenses;
  • the date, time and expected length of the work;
  • the location and how access will work;
  • when payment is due; and
  • cancellation, rescheduling, refund and dispute terms.

Agree to any change in scope or price before the extra work is done or charged.

6.3 Contracting laws. New York law may require written contracts or timely payment for some engagements, including under the Freelance Isn’t Free Act where it applies. Households and Professionals are responsible for meeting any such rules. These Terms are not that contract.

6.4 Minty’s role. Minty is not a party to a Service Agreement. The Household and the Professional are responsible for their own performance and for enforcing their agreement. Minty does not set cancellation policies for services, decide whether work was satisfactory, promise replacement work, settle service disputes, or guarantee either side’s payment or performance. Scheduling, messaging and payment tools do not change this.

6.5 Your rights are preserved. Nothing here prevents you from reporting misconduct, seeking legal remedies, making a lawful chargeback or contacting a regulator. Minty may act on misuse of the Platform and cooperate with lawful requests without taking on the job of resolving the underlying service dispute.

7. Households: your responsibilities

7.1 Choose carefully. Before you hire, evaluate suitability, references, qualifications, insurance and any license the work requires. Do not rely only on a badge, review, screening status or Listing. Minty does not guarantee availability, credentials, compatibility or results.

7.2 Give accurate information and a safe setting. Provide accurate details about the work, tell the Professional about material hazards, secure weapons and dangerous animals, arrange lawful access, and give any permissions the work needs.

7.3 Make appropriate requests. Do not ask for unsafe or unlawful tasks, work outside the agreed scope, or services that are not allowed under Section 5. Share only the health information needed to keep everyone safe.

7.4 Employer duties. Households are responsible for deciding whether their direct relationship with a worker creates employer duties, such as household employment taxes, wage rules, workers’ compensation or disability coverage. Calling someone a Professional or an independent business does not remove those duties where the law finds an employment relationship.

7.5 Safeguarding. If someone is in immediate danger, call 911. If you believe an older adult or other vulnerable person is being abused, neglected or exploited, contact local adult protective services or law enforcement. Minty may report concerns to the authorities where the law allows.

8. Professionals: your responsibilities

8.1 Your business, your duties. You are responsible for the services you agree to provide, for your Listing, for your lawful business operations, and for the acts and omissions of the people you engage. Offer only services you are competent and legally authorized to perform.

8.2 Licenses, permits and insurance. Obtain and keep, at your own expense, every license, permit, registration and insurance policy that the law requires for your work, plus liability coverage suited to your business. Do not list services that are not allowed under Section 5.

8.3 Honest Listings. Keep your Listing accurate and current. Do not say or suggest that Minty employs, licenses, insures, certifies or endorses you, or that you hold a credential you do not have. If a badge or status appears on your profile, describe it accurately.

8.4 Work authorization. You and your Assistants must be legally authorized to work in the United States. Each person who employs or engages a worker must meet the employment-verification duties that actually apply to that relationship. Using Minty does not decide whether a form such as an I-9 is required.

8.5 Your tools and your risk. You supply and pay for your own tools, equipment, transportation and business resources unless you agree otherwise with the Household. You bear your business expenses and the chance of profit or loss. Minty does not promise any number of customers, bookings or earnings.

8.6 Assistants. You may engage lawful employees, subcontractors or Assistants, subject to your Professional Agreement, the law, and the access and identity requirements you agreed with the Household. Tell the Household who will enter the home and do the work. Anyone who must be screened under Section 9 must complete Screening before performing covered services. Assistants may not use another person’s credentials or badge. You remain responsible for your Assistants’ pay, lawful classification, taxes, supervision, insurance and compliance. Assistants do not become Minty’s workers.

9. Identity checks, background screening and verification

9.1 What we require. Before a Professional is listed, Minty requires background screening and identity verification through Checkr. Identity verification may include a government-issued ID and a selfie through the designated secure process. For transportation, each driver must complete motor vehicle record (MVR) screening through the designated screening process before Minty enables the affected transportation Listing or bookings. MVR screening is a mandatory transportation eligibility requirement. We may require other checks appropriate to a service category. We may ask Assistants who will enter homes to complete Screening too.

9.2 Fees and scope. Professionals pay the screening fee disclosed for their screening package. We will tell you the scope of a check and any fee before you pay. Paying for a check does not guarantee a clear result, approval, bookings or earnings. An initial payment covers only the package described when you paid. It is not a promise of lifetime screening or permanent eligibility. Periodic rechecks may be required under our screening policy, with any authorization the law requires and advance notice of any new charge. Refund terms for a screening charge will be disclosed before you pay and remain subject to law.

9.3 Your consent. You provide your information and authorizations directly to Checkr through its secure process, accessed either through an embedded form on the Platform or through a secure Checkr invitation link sent by email. Minty may send the invitation manually or through an automated workflow. An email invitation provides access to the secure process; do not send sensitive screening information by ordinary email. Sensitive details you enter in Checkr’s form, such as a Social Security number, go to Checkr. Paying for a check does not by itself authorize a consumer report, and these Terms do not replace the stand-alone disclosure, authorization and notices that the Fair Credit Reporting Act (FCRA) requires.

9.4 What Minty receives and shares. Minty receives screening status and results and may receive an authorized report as described in the Professional Agreement, the separate screening disclosures and applicable law. We do not publish screening reports or provide them to Households or other Members as part of the marketplace service. A screening status or badge describes only the specific check completed. Disclosures required by law or valid legal process remain subject to the Privacy Policy and applicable law.

9.5 Using reports lawfully. Minty must follow the FCRA and applicable New York law when obtaining or using consumer reports. A Household that independently obtains or uses a consumer report outside Minty is responsible for its own compliance with applicable law. Minty will not request or rely on dismissed charges, arrests or charges that did not result in conviction, youthful offender adjudications, sealed records, or other criminal-history information protected from use by applicable law when deciding platform eligibility. Minty will instruct its screening provider to exclude those records from reports supplied to Minty. Before ordering a consumer report, Minty will provide a clear, stand-alone written disclosure and obtain written authorization through the designated screening process. Registration, acceptance of these Terms and payment for screening do not replace that disclosure or authorization. Before rejecting, restricting, suspending or removing a Professional based wholly or partly on a consumer report, Minty will provide a pre-adverse action notice, a copy of the report relied on and the applicable summary of rights, and allow a reasonable opportunity to review and dispute inaccurate or incomplete information before making a final decision. If Minty then takes adverse action, it will provide a final adverse action notice identifying the reporting agency, explaining that the agency did not make the decision, and describing the Professional’s rights to dispute the report and obtain a free copy within 60 days, together with any additional information required by law. Minty will provide a copy of New York Correction Law Article 23-A when the report contains criminal conviction information, and will consider the factors in Section 753 of the New York Correction Law when evaluating a conviction.

9.6 If a report is wrong. Disputes about the accuracy of a report go to the agency that prepared it. You may also tell us a dispute is pending.

9.7 Credential and insurance documents. Where permitted by law and requested by Minty, Professionals must submit current licenses, permits, registrations, insurance records, kitchen documentation and other service-related credentials through the designated secure, non-public document-upload area of their Minty Professional profile. This requirement includes, but is not limited to, transportation, meal preparation and any other service category for which documents are lawfully requested. Submit only the requested documents; do not post them in public fields or send them through ordinary messages or ordinary email. If secure profile uploads are unavailable, contact support for instructions before submitting documents. We handle uploaded information as described in our Privacy Policy, including its access, disclosure and retention provisions. Transportation documents are subject to the specific checks in Section 13.4. For other documents, we may review whether a requested item was provided and appears current; unless we expressly say otherwise, we do not confirm those other documents with the issuing authority or insurer. Receipt or review is not a legal finding that a business is properly licensed or insured and does not mean Minty provides or supervises services. Keep your documents current, provide updated documents when requested or when a required document expires or changes, and tell us promptly if a required license or coverage ends.

9.8 What labels mean. “Verified,” “background check completed” and similar labels describe only the specific process named. They are not a guarantee of safety, a professional license, insurance, an endorsement or a promise about quality of work. Screening reflects the sources, places, identifiers and time period covered. It can be incomplete or inaccurate, and it does not predict future conduct.

9.9 Our commitment on verification claims. We will describe our verification steps accurately and will not claim to have checked something we have not. Members must not overstate what has been verified.

10. Fees, payments and Stripe

10.1 Professional rates. Professionals set their own rates and agree on charges directly with Households. Minty does not pay Professionals wages or buy their services.

10.2 Household service fee. Under the Household Agreement, the Household service fee is 15% of the total paid for services contracted through the Platform. It is a charge to the Household and does not reduce the Professional’s agreed rate. We will show the fee, any processing charges, taxes and the total before you authorize payment. Do not assume any other charge from these Terms; only charges disclosed and accepted at checkout or in an accepted agreement apply. Under the Professional Agreement, Minty charges Professionals no listing or platform-access fee. Screening charges are described in Section 9.

10.3 Pay through the Platform. Payments for bookings made through Minty, and for services between parties whose connection was first made through Minty, must use the Platform’s designated payment process, which currently uses Stripe. Do not request, accept or make cash payments, checks, personal payment-app transfers or other off-platform payments for those services, subject to applicable law. See Section 10.4 for repeat bookings.

10.4 Bookings and payments for Minty connections. When a Household and a Professional first connect through Minty, all bookings and payments for Services between those parties must be made through Minty’s website and its designated payment process, including repeat Services. This requirement has no fixed end date. Neither party may move those bookings or payments off the website to bypass this requirement. Neither party is required to request, accept or continue Services, and each party remains free to work with other people. This rule applies to connections first made through Minty and does not cover relationships that existed independently before the parties connected through Minty. It does not create a buyout or conversion fee and remains subject to applicable law.

10.5 Stripe. To book or get paid, you must complete Stripe’s onboarding and verification, give accurate payment and tax information, and accept Stripe’s terms. Stripe and its partner banks may collect information directly. Stripe may apply lawful verification steps, reserves, payout delays, reversals and chargeback procedures. Minty may take administrative actions that the law, Stripe or an accepted payment instruction requires. Those actions are not a decision about whether either side performed its Service Agreement. Minty remains responsible for the duties that apply to Minty under its Stripe arrangements.

10.6 Charges and holds. A Household authorizes only the charges disclosed and accepted through the booking or checkout process. A card authorization may create a temporary hold. The timing of payment capture, any completion-confirmation step and payout timing will be shown in the payment flow. These Terms do not allow an undisclosed automatic charge or a charge for extra work that was not agreed.

10.7 Overdue balances. Minty may block new bookings while an undisputed, authorized balance is overdue, subject to the law and your agreement with us. Closing an account does not speed up a payment that is genuinely disputed or not yet due. Amounts that are validly due remain due.

11. Cancellations, refunds and payment disputes

11.1 No Minty cancellation fee. Minty does not set a cancellation window or charge a cancellation penalty under these Terms. Cancellation, rescheduling and service-refund rights are set by the Service Agreement and the law.

11.2 Service refunds. Refunds for a Professional’s Services are governed by the separate Service Agreement between the Household and Professional and applicable law. Minty does not determine entitlement to service refunds or resolve service disputes. A refund through Stripe must follow the proper authorization, Stripe’s requirements and applicable law.

11.3 Minty’s service fee. Minty’s platform service fee is generally non-refundable, except as disclosed at checkout or required by applicable law. Nothing here limits the correction of a payment error or a protected dispute right. Closing, suspension or termination of an account does not eliminate any refund rights required by law or by itself determine whether a valid charge or refund is owed.

11.4 Working it out. Households and Professionals are expected to resolve service disputes directly and in good faith. You may contact Minty at support@mintycareconnections.com to report a problem or ask us to pass on a message, but we do not take on the role of judge.

11.5 Chargebacks. Nothing here stops you from making a lawful chargeback or payment dispute. Where you can, please contact the other side first.

12. Taxes

Each person is responsible for the income, self-employment, payroll, sales, use and other taxes and reporting duties that apply to them. Professionals handle their own business taxes and their obligations to their workers. Households handle any household-employer or other duties the law places on them. Minty does not withhold payroll taxes for independent businesses. Minty and Stripe will collect, withhold or report where the law requires them to.

Where reasonably necessary to carry out a legal obligation or look into documented non-compliance, Minty may ask for appropriate confirmation of tax compliance and may limit access for a substantiated violation, subject to the law. Do not send complete tax returns, Social Security numbers or other unnecessary sensitive information in ordinary messages. A request for documents does not give Minty control over how a Professional does the work. No indemnity in these Terms moves a legal duty away from the person the law makes responsible for it.

13. Transportation

13.1 What is allowed. Transportation Listings are limited to permitted, non-emergency transportation for independently mobile adults. Minty does not supply vehicles or drivers, dispatch trips, direct routes, set fares or driver schedules, or provide transportation itself. The Household and the transportation Professional agree directly on the service.

13.2 What is not allowed. No emergency medical transportation, clinical monitoring, medical assistance, or hands-on lifting or transfer of a person who cannot get in and out of a vehicle on their own may be offered through the Platform.

13.3 Professionals’ legal duties. Transportation Professionals must find out about, obtain and keep the operating authority, passenger-for-hire permits, driver licensing, vehicle registration, inspections and insurance that the law requires for what they actually do and where they do it. New York State and local passenger-for-hire and transportation-network rules may apply. A personal auto policy often excludes paid passenger service. Keep commercial auto liability coverage suited to the service, and name Minty as an additional insured where the Professional Agreement or another written requirement we give you calls for it. A certificate alone does not prove additional-insured status. An endorsement issued by the insurer is needed.

13.4 Transportation document checks and renewals. Before enabling transportation services, Minty requires and checks current documents for each driver and each vehicle used: (1) a New York Class E driver’s license or an appropriate Class A, B or C commercial driver’s license, including any endorsements required for the vehicle and passenger service, matched to the driver’s screening identity; (2) DMV registration establishing taxi, livery or other eligible for-hire vehicle status and seating capacity; (3) commercial or for-hire automobile liability insurance covering the vehicle and the paid passenger service, with matching vehicle details, applicable coverage limits and expiration date; and (4) all driver and vehicle licenses, permits or operating approvals required by the state and local authorities for the areas served. A driver’s license alone, a personal-use vehicle registration or a personal automobile insurance policy does not satisfy this platform requirement. Where vehicle size, capacity, operating area or service type requires additional authority, Minty also requires proof of applicable NYSDOT operating authority or a documented exemption and Article 19-A compliance where applicable. Submit the required documents through the secure, non-public upload area of your Minty Professional profile under Section 9.7. Minty checks the driver identity, license class and relevant endorsements, vehicle identifiers, for-hire status, seating capacity, coverage information, applicable operating area and expiration dates across the submitted records. If information is missing, inconsistent or unclear, Minty requires clarification or confirmation from the issuing authority, insurer or other appropriate source before enabling the affected transportation services. Minty records review status and expiration dates and rechecks replacement or renewed documents. Transportation listings and new bookings must remain unavailable while required documents are missing, expired, suspended, cancelled or unresolved. Professionals must promptly report any change affecting eligibility and must not provide affected transportation services unless the required credentials and coverage are current. Each driver must also complete the mandatory MVR screening required by Section 9.1 before Minty enables the affected transportation Listing or bookings.

13.5 Limits of document review. The checks in Section 13.4 concern eligibility to use the transportation features of the Platform. They do not grant operating authority, replace a regulator’s licensing decision or an insurer’s coverage determination, guarantee authenticity or continuing compliance, or guarantee safe service. Professionals remain responsible for obtaining and maintaining all required credentials, inspections and coverage. Minty does not provide transportation, dispatch drivers, direct routes or supervise service performance.

14. Meal preparation and food safety

14.1 Permitted preparation locations. Meal preparation may take place in the client Household’s kitchen for that Household, or in an approved commercial kitchen for sale or delivery where the Professional’s food business and activities are covered by all required permits, licenses and authorizations. Outside the client Household’s home, the Professional must have the applicable local health department food-service permit, a New York State Department of Agriculture and Markets food-processing license where applicable, and any other required approvals. The applicable authorization must cover the Professional’s operation, food products and preparation location; renting space in a permitted kitchen does not by itself establish that the Professional’s operation is authorized. As a Minty platform rule, Professionals may not prepare meals in their own or another person’s personal home kitchen for sale or delivery through Minty. This restriction does not prohibit cooking in the client Household’s own kitchen for that Household. A home-processor exemption does not override this platform restriction. Professionals must identify their preparation location accurately, maintain the credentials that apply, and submit requested current permits, licenses and proof of commercial-kitchen access through the secure, non-public upload area of their Minty Professional profile under Section 9.7. Minty’s receipt or review of documents concerns platform eligibility and does not constitute a food-business license, kitchen inspection or guarantee of compliance.

14.2 Agree on the details. Households and meal Professionals should agree on ingredients, known allergies, storage, kitchen access and the scope of the work.

14.3 Food safety. Professionals are responsible for safe preparation, sanitation, handling, transport and temperature control. Minty does not inspect kitchens, certify food safety, guarantee that a meal is allergen-free, or provide nutrition or dietary treatment.

15. Companionship, cleaning, yard care and other boundaries

15.1 Companionship. Friendly visits and companionship are non-medical social support. They do not include nursing, medication administration, diagnosis, treatment, clinical observation, hands-on personal care or emergency supervision.

15.2 Not a substitute for licensed care. Listings on Minty are not a substitute for licensed care or emergency services. If someone needs medical or personal care, they should contact a licensed provider.

15.3 Other categories. Cleaning, laundry, yard care, errands and any other category must stay within the Professional’s lawful qualifications and the limits in Section 5. As a Minty platform rule, yard-care services may not include applying pesticides, herbicides, weed killers, weed-and-feed products or other products intended to control weeds, insects or other pests, whether sprayed, spread or applied by another method. This exclusion applies even if the Professional holds pesticide-related certification or licensing. Permitted yard care may include mowing, raking, planting, hand weeding and general yard cleanup, subject to applicable law and other platform limits. Households may not request, and Professionals may not offer or perform, the excluded yard-care activities through Minty. Errand services may not include transporting passengers.

16. Safety, injuries, property and insurance

16.1 Know the risks. Meeting people online, letting people into homes, travelling, preparing food, using tools and working near others all carry risk. Use reasonable judgment. Stop any unsafe activity and call 911 when necessary. Minty does not supervise, train or monitor Members and cannot guarantee that every interaction will be safe or respectful.

16.2 Who is responsible for what. Professionals are responsible for the quality and safety of their work and, to the extent the law provides, for injury or damage caused by them or their Assistants. Households remain responsible for their own conduct, the condition of their property, their disclosures, and any premises or employer duties the law places on them. Fault and remedies depend on the contract and the law, not on which side complains first.

16.3 Insurance. Professionals must carry the insurance the law requires, including workers’ compensation and disability coverage where it applies to their workers, and liability coverage suited to their business. Minty does not provide household-service insurance, workers’ compensation, an injury fund or a service-quality guarantee.

16.4 What this does not do. Nothing here requires you to give up a claim that cannot legally be waived, or excuses Minty’s own legally actionable conduct.

17. Acceptable use

17.1 Prohibited conduct. Do not use the Platform for fraud, identity misuse, exploitation, theft, harassment, threats, unlawful discrimination, sexual misconduct, illegal services, or infringement of anyone’s rights.

17.2 Protect the Platform. Do not get around security controls, introduce malicious code, scrape non-public data, send unauthorized bulk messages, manipulate rankings, or use another Member’s contact details for unrelated marketing.

18. Reviews and ratings

Listings and reviews must be truthful and based on real experience. Do not buy or offer false reviews, tie benefits to positive reviews, hide a material connection, threaten anyone over honest feedback, or post private information. A review is not prohibited just because the business disagrees with it. Minty may moderate unlawful, fraudulent, abusive, irrelevant or privacy-invasive content. We do not promise to verify every statement, and we will not remove honest, legally protected reviews only because they are negative.

19. Your content and Minty’s content

19.1 Your content. You keep ownership of content you lawfully submit. You give Minty a non-exclusive, royalty-free license to host, copy, format, display and distribute it as reasonably needed to run the Platform, show your Listings and promote them within the Platform. This license does not let us publish confidential messages, identity documents, screening reports or private household details as advertising. We need separate permission for a testimonial or any identifiable promotional use outside the Platform.

19.2 What you promise about your content. You have the rights and permissions needed for what you submit, including photos of other people and business logos.

19.3 Minty’s content. Minty owns or licenses its software, branding, website design and original materials. You may use the Platform’s features for their intended purpose under a limited, revocable right. Do not copy Minty’s software, suggest a false affiliation with Minty, or reuse other Members’ content commercially without permission.

19.4 Copyright complaints. If you believe content on the Platform infringes your rights, email support@mintycareconnections.com with enough detail to identify the work, the material and where it appears, your authority to act, and your contact information. We may ask for more information and will handle notices as the law requires.

20. Privacy, messages and information security

20.1 Privacy Policy. Our Privacy Policy explains what information we collect, why, who receives it, how long we keep it and what choices you have. These Terms do not replace it.

20.2 Messages and Minty access. Messages, profiles, bookings and uploaded documents are stored on the Platform. Minty administrators and technical support providers may access them for moderation, support, safety, security and legal reasons. Please do not treat Platform messages as private from Minty.

20.3 Our security duties. Minty will use reasonable administrative, technical and physical safeguards and give breach notices where the law requires, including under New York General Business Law Sections 899-aa and 899-bb. No system is completely secure, and we cannot guarantee absolute security. Nothing here shifts our security duties onto you or waives your statutory rights.

20.4 Third-party services. Third-party providers may collect information directly under their own policies. Using them does not remove our duties for data we access or control.

20.5 Protect other people’s information. Information you receive about another Member, such as names, addresses, photos and job notes, may be used only for the engagement or another lawful purpose that person has approved. Do not sell, publish or misuse it. Report suspected exposure or misuse promptly to support@mintycareconnections.com.

21. Communications and third-party services

21.1 Service messages. We may send account, booking, payment, security and other necessary service messages using the contact details you gave us, subject to the law. Where the law requires separate consent to electronic delivery or signatures, we will ask for it and explain how to withdraw it and how to get a paper copy.

21.2 Marketing. These Terms are not consent to marketing emails, calls or texts. If we send marketing, we will ask for the consent the law requires for that channel, and you can opt out using the method we provide.

21.3 Third-party sites and tools. Links and integrations are governed by the third party’s own terms, and we do not guarantee how they perform. Minty remains responsible for its own statements and for legal duties that apply to its vendor relationships.

22. Suspension, closure and appeals

22.1 When we may act. Minty may limit features, remove content, suspend access or close an account for a material breach, fraud, unlawful conduct, a security risk, failure to meet lawful eligibility requirements, or where the law requires. We may apply an interim restriction during a reasonable investigation.

22.2 Notice. We will give notice and an explanation where the law requires it and it is reasonably practicable, subject to legal, privacy and security limits. Decisions based on Screening follow Section 9 and any notice and review steps the law requires.

22.3 Asking for review. You may ask us to review a decision within 14 days after receipt of notice by emailing support@mintycareconnections.com with your reasons and any supporting information. We will consider it and reply within a reasonable time. This does not shorten any legal right you have to challenge a decision. Any longer response, review, appeal or dispute period required by applicable law controls. This contractual review process does not replace the separate screening protections.

22.4 No workarounds. Do not create another account or identity to get around a restriction.

22.5 Closing your account. You may close your account at any time through the authenticated deactivation feature, where available, or by emailing support@mintycareconnections.com from your account email address. We may reasonably verify your identity. Closure is effective when authenticated deactivation is completed or we receive an authenticated closure request, unless you request a later date. We will confirm closure through a permitted notice method. A separate termination document signed by both parties is not required to exercise a closure right expressly permitted in the agreement you accepted. Closing ends access to account features but does not automatically cancel a separate Service Agreement, decide a service dispute, eliminate accrued payment duties or waive provisions that survive, including the booking and payment obligations for Minty connections. Records may be kept as the Privacy Policy and the law allow or require.

22.6 Telling other Members. Where needed for an affected booking, account security or legal compliance, Minty may tell relevant Members that an account is unavailable or closed. Those notices will be accurate, limited to what is necessary, and consistent with privacy and consumer-reporting law. An account’s status says nothing about a person’s character, criminal history or quality of service.

22.7 What continues. Terms that should reasonably continue after closure do, including accrued payment duties, intellectual-property protections, liability limits, indemnity and the dispute provisions.

23. Reporting problems and contacting us

23.1 How to reach us. Email support@mintycareconnections.com or write to Minty Care Connections LLC, 1726 Long Pond Road, Suite 5, Rochester, New York 14606. In an emergency or urgent safety situation, call 911 first.

23.2 What to tell us. Describe the concern, who was involved and when, and attach anything that helps, such as messages or screenshots. Please do not send sensitive identity or payment details by email.

23.3 What we may do. We may investigate, ask for information, limit access, remove content and cooperate with the authorities. We cannot promise a particular outcome, and we do not take on the job of resolving service disputes between Households and Professionals.

23.4 Accessibility. If you have trouble using the Platform because of a disability or a language need, tell us and we will try to help or offer another way to get the information.

24. Disclaimers

TO THE EXTENT THE LAW ALLOWS, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” MINTY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT TO THE EXTENT THOSE DISCLAIMERS ARE LAWFUL. MINTY DOES NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE CONTENT, BOOKINGS, EARNINGS, THE SUITABILITY OF ANY MEMBER, OR ANY PARTICULAR SERVICE RESULT. WE MAY CHANGE, PAUSE OR DISCONTINUE FEATURES AT ANY TIME.

These disclaimers are about the Platform and Minty’s own statements. They do not rewrite a Service Agreement between a Household and a Professional, excuse a Professional’s promises, or remove a warranty or duty that cannot lawfully be excluded. A specific written commitment that Minty expressly makes stays subject to its terms and the law.

25. Limits on Minty’s liability

25.1 Excluded damages. TO THE FULLEST EXTENT THE LAW ALLOWS, MINTY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES OR LOST GOODWILL, ARISING FROM USE OF THE PLATFORM.

25.2 Overall cap if you accepted an agreement. FOR A HOUSEHOLD, ANY OVERALL CAP IS THE ONE IN THE HOUSEHOLD AGREEMENT: THE SERVICE FEES THAT HOUSEHOLD PAID TO MINTY IN THE 6 MONTHS BEFORE THE CLAIM AROSE. FOR A PROFESSIONAL, IT IS THE CAP IN THE PROFESSIONAL AGREEMENT: THE SERVICE PAYMENTS THAT PROFESSIONAL RECEIVED FROM HOUSEHOLDS IN THE 6 MONTHS BEFORE THE CLAIM AROSE. IF THE AGREEMENT YOU ACCEPTED SAYS SOMETHING DIFFERENT, THAT AGREEMENT CONTROLS (SECTION 1.4).

25.3 Overall cap for everyone else. FOR ANYONE WHO HAS NOT ACCEPTED A HOUSEHOLD AGREEMENT OR PROFESSIONAL AGREEMENT, SUCH AS A VISITOR OR A REPRESENTATIVE ACTING WITHOUT ONE, MINTY’S TOTAL LIABILITY IS LIMITED, TO THE FULLEST EXTENT THE LAW ALLOWS, TO THE GREATER OF $100 OR THE AMOUNTS THAT PERSON PAID TO MINTY IN THE 6 MONTHS BEFORE THE CLAIM AROSE.

25.4 What the limits do not cover. THESE EXCLUSIONS AND CAPS DO NOT APPLY TO FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR ANY LIABILITY, REMEDY, WARRANTY OR STATUTORY RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. THEY ALSO DO NOT AFFECT YOUR OWNERSHIP OF SERVICE PROCEEDS OR MINTY’S DUTY TO ACCOUNT FOR FUNDS IT IS LEGALLY REQUIRED TO PASS ON. WHETHER A LIMIT CAN BE ENFORCED IN A PARTICULAR CASE IS DECIDED BY THE APPLICABLE LAW. SUBJECT TO THESE EXCEPTIONS, THE EXCLUSIONS AND CAPS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING TO CLAIMS ALLEGING ORDINARY NEGLIGENCE WHERE SUCH LIMITATIONS ARE LAWFUL.

26. Indemnification

26.1 What you agree to. To the fullest extent permitted by applicable law and subject to Sections 26.2 and 26.3, you will indemnify, defend and hold harmless Minty and its members, managers, officers, employees and agents against third-party claims, damages and reasonable legal costs, to the extent caused by your material breach of these Terms, unlawful conduct, infringement of another person’s rights, or negligent or wrongful acts in connection with a service engagement. For a Professional, this includes claims connected to its Assistants, its service performance, and the tax, employment, insurance or licensing duties the law places on it. For a Household, this includes claims connected to unsafe conditions at the home, unauthorized instructions, or household duties the law places on it.

26.2 Limits. This indemnity does not require you to cover any portion of a claim attributable to Minty’s or a protected party’s own negligence or other wrongdoing, or to assume a duty that cannot lawfully be delegated. A claim involving conduct by both parties does not eliminate indemnification for the portion attributable to you or, where applicable, your Assistants. These limits apply to all indemnification obligations under these Terms.

26.3 How it works. Minty must give prompt notice of a covered claim and reasonable cooperation. The indemnifying Member may control the defense with competent counsel. Minty may take part at its own cost, and may use separate counsel where there is a conflict. No settlement may admit fault by Minty, require Minty to take non-monetary action, or leave Minty without a release unless Minty reasonably agrees.

26.4 The agreements. The Household Agreement and Professional Agreement have their own indemnity terms, and Section 1.4 and mandatory law apply to them.

27. Governing law and disputes with Minty

27.1 Governing law. New York law governs these Terms, subject to controlling federal law and any mandatory protections that apply to you.

27.2 Where claims may be brought. Subject to those protections and to jurisdiction rules, disputes between you and Minty arising from these Terms may be brought in a state court of competent jurisdiction in Monroe County, New York, or in the federal court that covers Monroe County. This section does not choose a court for a dispute between a Household and a Professional.

27.3 No arbitration. These Terms do not require arbitration and do not waive class actions.

27.4 Talking first. You may contact us to try to resolve a problem informally, but you do not have to do so before filing a claim, protecting a deadline, seeking urgent relief or contacting a government agency. These Terms do not shorten any legal time limit for bringing a claim.

28. Changes to these Terms

Minty may revise these Terms going forward. Revised Terms will show a new effective date. For material changes we will give reasonable advance notice, unless urgent legal or security reasons require shorter notice. Where we need your acceptance, we will ask for it before the changes bind you. Changes do not rewrite accrued claims, completed transactions or a Service Agreement, and they do not amend a Household Agreement or Professional Agreement except through the amendment process in that agreement.

29. General terms

29.1 If part is unenforceable. If a provision cannot be enforced, the rest continues to the extent the law allows.

29.2 No waiver. Not enforcing a provision once does not waive it later.

29.3 The whole agreement. These Terms, the Household Agreement or Professional Agreement you accepted, and the Privacy Policy together make up the agreement between you and Minty on their subjects.

29.4 No third-party rights. These Terms create no third-party rights, except the protections for Minty’s members, managers, officers, employees and agents in Sections 25 and 26.

29.5 Transfers. You may not transfer your rights or duties under these Terms in a way that unlawfully reduces anyone else’s rights. Minty may transfer these Terms in a merger, sale or reorganization, and any successor stays bound by Minty’s obligations.

29.6 Notices. Notices under these Terms must be in writing. You may notify Minty by email to support@mintycareconnections.com or by mail or personal delivery to the address in Section 23.1. We may notify you at your current account email address, through a notice delivered to an accessible Platform account with an email alert, or by mail or personal delivery to the mailing address you provided. Keep your contact details current. Email is effective when delivered to the designated email system, not merely when sent; an automated failure or undeliverable response is not delivery. Platform delivery is effective when the notice is delivered to an accessible account with an email alert sent to your account address. If your account is inaccessible or electronic delivery fails, we will use another legally permitted method. Mail and personal delivery are effective on documented delivery. We retain available delivery records. Legally required delivery methods, separate electronic-delivery consent, notice periods and statutory response or dispute rights control over these general procedures. Section 21.1 applies to electronic-delivery disclosures and consent. Screening notices follow Section 9. These procedures do not authorize service of court papers by email or through the Platform. Your accepted Household Agreement or Professional Agreement governs notices under that agreement.

29.7 Events beyond our control. Neither side is liable for delay or failure caused by events beyond its reasonable control, such as outages, severe weather or government action. This does not excuse a payment that is due.

29.8 Headings. Headings are for convenience only.
